Terms & Conditions
These Terms & Conditions govern the provision of services by VerifyCar (“VerifyCar”, “we”, “us”) to clients (“Client”, “you”).
By confirming a VerifyCar service after having the opportunity to review these Terms, the Client acknowledges the nature and limitations of a pre-purchase vehicle inspection and agrees to these Terms.
1. Nature of Service
VerifyCar provides independent mobile pre-purchase inspections of used vehicles.
Depending on the vehicle and inspection conditions, the service may include visual inspection of the body and paint, paint-thickness measurements, inspection of the engine compartment, checks of accessible fluids and visible leaks, computer scanning of available electronic systems, battery testing, visual assessment of tires and brakes, inspection of accessible suspension and underbody components, checks of available vehicle equipment, a road test when available and permitted, and a general professional assessment of the vehicle’s condition at the time of inspection.
The actual scope of the inspection depends on the vehicle’s design and condition, accessibility of components, inspection location, weather and lighting conditions, and permission from the vehicle owner or seller.
2. Not a Manitoba Safety Inspection
A VerifyCar inspection is not an official Manitoba Certificate of Inspection (Safety Inspection).
VerifyCar does not perform an official Manitoba Safety Inspection and does not issue a Safety Certificate.
During a pre-purchase inspection, VerifyCar may identify and inform the Client about defects that could potentially affect a Safety Inspection.
However, VerifyCar does not guarantee that a vehicle will pass or fail an official Safety Inspection. The final determination of compliance with applicable Safety requirements is made by an authorized inspection station and qualified inspector performing the official Safety Inspection.
3. Inspection Limitations
VerifyCar performs the agreed inspection professionally and with reasonable care within the scope of the service.
A pre-purchase inspection reflects the condition of the vehicle that can reasonably be assessed at the time of inspection.
The inspection does not include disassembly of the engine, transmission, body, or other vehicle components. A mobile inspection is normally performed without a vehicle lift.
Because of the nature of a pre-purchase inspection, some hidden, internal, intermittent, or not-yet-developed defects may not be detectable.
Some defects may require component disassembly, a vehicle lift, specialized in-depth diagnostics, or extended vehicle operation to identify.
4. Computer Diagnostics
Computer scanning reflects information available through the vehicle’s electronic systems at the time of inspection.
The absence of active or stored diagnostic trouble codes does not by itself mean that no technical problem exists.
Codes may have been cleared before the inspection, a fault may be intermittent, or the conditions required to set a code may not yet have occurred. Some mechanical or other faults may not generate diagnostic trouble codes at all.
5. Remaining Service Life
The purpose of a VerifyCar inspection is to assess the vehicle’s current condition, not to determine the exact remaining service life of its components.
A pre-purchase inspection cannot determine the exact future service life of an engine, automatic transmission, CVT, turbocharger, all-wheel-drive system, battery, electronic component, or other vehicle component.
Normal operation of a component at the time of inspection is not a guarantee of its future service life.
6. Road Test
A road test is performed only when it is safe and lawful to do so and when the vehicle owner or seller gives permission.
For a road test, the vehicle must have valid registration and insurance coverage required for lawful operation on public roads.
VerifyCar does not perform a road test on a vehicle that does not have the required registration or insurance coverage.
VerifyCar may also decline a road test if the condition of the vehicle, road or weather conditions, or other circumstances create a reasonable safety risk.
If a road test cannot be performed because of missing registration or insurance, refusal by the seller, vehicle condition, or other circumstances outside VerifyCar’s control, the remaining available parts of the inspection may be completed without a road test.
The inability to perform a road test for these reasons does not by itself entitle the Client to a refund for an inspection that has otherwise been performed.
7. Seller Information and Vehicle History
VerifyCar may consider documents and information provided by the Client, seller, owner, or other third parties.
VerifyCar does not automatically verify the accuracy of such information.
This may include reported mileage, maintenance history, accident or repair history, vehicle status, and other information about the vehicle’s past.
CARFAX and other third-party information services may also contain incomplete information.
Information that has not been independently confirmed by VerifyCar should not be treated as verified by VerifyCar.
8. Inspection Results and Client Decision
VerifyCar provides the Client with independent technical information and a professional assessment of the vehicle’s observed condition.
VerifyCar may explain identified defects, potential risks, and possible consequences.
This information is intended to assist the Client in making an informed decision, but the final decision whether to purchase the vehicle, decline the vehicle, negotiate the price, or perform repairs remains with the Client.
VerifyCar is not a party to the purchase or sale agreement between the buyer and seller.
9. Repair Cost Estimates
VerifyCar may provide an approximate estimate of possible repair or maintenance costs.
Unless expressly stated otherwise, such an estimate is provided for informational purposes only and is not a repair-shop quotation or an offer to perform repairs for the stated amount.
Actual costs may vary depending on the repair facility, parts cost and quality, labour requirements, and additional problems discovered during disassembly or repair.
For an exact repair cost, the Client should obtain an estimate from an appropriate repair facility.
10. Payment and Prepayment
The service price is communicated and agreed with the Client before the inspection.
If the Client will not be present at the inspection, VerifyCar may require full prepayment before the inspector departs for the inspection location.
Applicable taxes are added as required by law.
11. Cancellation or Rescheduling
The Client may cancel or reschedule an inspection without a cancellation fee if VerifyCar receives notice at least one hour before the agreed inspection time and before the inspector has departed.
If the inspection is cancelled less than one hour before the agreed time, or after the inspector has already departed for the inspection location, a cancellation fee of $20 plus applicable taxes applies.
If the Client has prepaid, the remaining amount after the applicable cancellation fee may be refunded to the Client or, by agreement, credited toward a future inspection.
12. Vehicle Access and Inspection Conditions
The Client is responsible for coordinating the inspection time and location with the seller and for ensuring that the seller permits the inspection.
The vehicle must be reasonably accessible for the agreed inspection.
Poor lighting, darkness, snow, rain, dirt, ice, vehicle positioning, inaccessible or closed components, or other conditions may limit the scope of the inspection.
Material limitations affecting the inspection results will be communicated to the Client when relevant.
VerifyCar may decline any action that is unlawful, unsafe, or creates a reasonable risk of damage to the vehicle.
13. Inspection Report
Inspection results may be provided to the Client verbally, in writing, or electronically and may include photographs, measurements, and computer diagnostic results.
The report reflects inspection findings and information available at the time of inspection.
The report is not a guarantee of the vehicle’s future condition or future trouble-free operation.
14. VerifyCar Liability
VerifyCar is responsible for performing the agreed service properly and professionally in accordance with applicable law.
At the same time, a pre-purchase inspection is not, by its nature, a guarantee that every vehicle defect will be identified.
To the extent permitted by applicable law, VerifyCar is not responsible for hidden defects or faults that could not reasonably have been identified within the agreed scope of the inspection, faults that arise after the inspection, or third-party information whose accuracy VerifyCar did not independently confirm.
VerifyCar is also not responsible for the Client’s independent decision to purchase or not purchase a vehicle, the price agreed between buyer and seller, or actions taken by the seller after the inspection.
Nothing in these Terms excludes or limits any right of the Client or any liability of VerifyCar that cannot lawfully be excluded or limited under applicable law.
15. No Guarantee of Future Vehicle Condition
A pre-purchase inspection is not a vehicle warranty or insurance policy.
VerifyCar does not guarantee that a vehicle will not require repairs after the inspection or that future faults will not occur.
Any specific assessment made by VerifyCar concerns the information and observable conditions available at the time of inspection.
16. Independence of VerifyCar
VerifyCar is an independent pre-purchase vehicle inspection service.
VerifyCar is not the vehicle seller, an automobile dealer, a party to the purchase agreement, or a repair facility in connection with this inspection service.
Unless expressly disclosed to the Client, VerifyCar does not receive a commission or other payment from the seller for the sale of a specific vehicle.
17. Acceptance of Terms
VerifyCar services may be booked by phone or electronic messaging.
By confirming an inspection after having the opportunity to review these Terms, the Client agrees to them.
The current Terms & Conditions are available on the VerifyCar website.
18. Governing Law
These Terms are governed by the applicable laws of the Province of Manitoba and the federal laws of Canada.
19. Changes to Terms
VerifyCar may update these Terms & Conditions from time to time.
The current version is published on the VerifyCar website and applies to new service bookings after publication.
